ORDER SEALING DOCUMENTS

On July 31, 2015, the defendant, Steven James Sitler, defendant’s counsel, Dean Wullenwaber and Mark Monson, and the State’s attorney, William W. Thompson, Jr., appeared before this Court on the State’s motion to review the terms and conditions of the defendant’s probation. At the hearing, the parties requested some clarification regarding which documents contained in the Court file are public record.

This Court finds that the documents listed below “contain highly intimate facts or statements, the publication of which would be highly objectionable to a reasonable person.” I.C.A.R. 32(i)(1). Further, in weighing the interests of the public against the defendant’s privacy interest, the documents listed below should be sealed to reasonably preserve the defendant’s privacy.

IT IS ORDERED that the following documents are SEALED, pursuant to I.C.A.R. 32(i):

  • The Psychosexual Evaluation, conducted by Dr. Paul M. Wert, that is attached to the Special Progress Report; and
  • The Polygraph Report, authored by Bill Crawford, dated July 29, 2015.
