ORDER AUTHORIZING RELEASE OF SEALED RECORDS
The above matter having come before the Court during the telephonic hearing held on September 8, 2015; the State appearing through the Latah County Prosecuting Attorney and the Defendant appearing through his counsel, Dean Wullenwaber; the State having verbally advised Court and counsel that the Idaho Department of Health and Welfare, has contacted the State and advised that they are opening an investigation into the circumstances involving the Defendant’s minor child and, as part of that investigation, is requesting copies of various documents and materials that are currently sealed herein; the Defense indicated that it had no objection to the sharing of this information with the Department of Health and Welfare with the understanding that Child Protective investigations are statutorily confidential; and good cause appearing:
IT IS HEREBY ORDERED that the State may disclose to the Idaho Department of Health and Welfare such sealed documents as it may request as part of its investigation. Any such disclosures shall be accompanied by a cover letter (copied to Court and counsel) specifying what materials are being provided.
