Subject of Proceedings: INITIAL APPEARANCE ON PROBATION VIOLATION

This being the time fixed pursuant to order of the Court for defendant’s initial appearance on an alleged probation violation in this case, Court noted the presence of counsel; Jackye Squire and the defendant.

In response to inquiry from the Court, Mr. Wullenwaber stated that he had been provided with a copy of the Report of Violation dated June 18, 2007, about fifteen minutes ago and that he has not yet had an opportunity to review it with the defendant. Mr. Wullenwaber stated that the defendant is prepared to proceed at this time.

Court informed defendant that it had been alleged that he was in violation of the terms of his probation and informed defendant of his rights and of the procedures to be followed.

Mr. Thompson argued in support of the State’s Motion for Bench Warrant in this case, recommending that an adequate. Bond be fixed with a condition that the defendant not return to his current residence. Mr. Thompson informed the Court that the probation department just learned that the defendant’s current residence is within too close a proximity to a daycare center. Mr. Wullenwaber stated that the defendant is not opposed to finding a new residence and argued in support of a low bond or release on the defendant’s own recognizance. Mr. Thompson argued in rebuttal. Mr. Wullenwaber argued in surrebuttal. Court issued the Bench Warrant; fixing bond in the amount of $25,000.

At the request of Mr. Wullenwaber, there being no objection from the defendant, Court entered a denial on behalf of the defendant.

Court scheduled a status conference at 1:30 P.M. on June 26, 2007, indicating that it would· allow counsel to participate by telephone.

Mr. Thompson informed Court and counsel that the State intends to file another allegation that defendant is in violation of his probation for his failure to comply with Dr. Lombard’s direction.

If the defendant is able to post bond, Court informed him that he may not return to his present residence except in the company of his probation officer to retrieve his belongings.

Defendant was remanded to the custody of the Latah County Sheriff pending further court appearance or earlier posting of bond.

Court recessed at 2:14 P.M.
